1. Acceptance of Terms

By using this website, you confirm that you are at least 18 years old or have the consent of a parent or guardian when attempting to purchase a product or a subscription. This is because individuals under 18 years old may face restrictions when it comes to using payment methods, especially to pay for exclusive content. You agree to use the website in accordance with these Terms of Service and all applicable laws. Everyone else of all ages is free to access this website, unless they want to buy something.

2. User Responsibilities

You agree to:

• Provide accurate, current, and complete information when creating an account or making a purchase.
• Maintain the security of your password and account.
• Notify me immediately of any unauthorized use of your account or any other breach of security.
• Take responsibility for all activities that occur under your account.
• Not interfere with this website in any way that hinders my activities or the website's operation and uptime.

3. Copyright and Content Ownership

All official Untilted membership comics and (specified) art by Cam R. are licensed under Creative Commons Attribution-NoDerivatives 4.0 International.

This license allows you to:

• Share and distribute the original work as is, with proper permission and attribution to the creator.

• Create derivative works for your own private, non-commercial use, such as remixing, transforming, or building upon the original material.

However, the license prohibits:

• Sharing or distributing derivative works publicly.

• Misrepresenting or attributing changes or modifications to the original creator.

The purpose of this restriction is to protect the integrity of the original work and prevent any potential damage to the creator's reputation. You are still encouraged to share your interpretations and re-interpretations of the work publicly, as long as they do not involve creating or sharing derivative works. The point is to strike a balance between allowing creative freedom and protecting the original work's integrity.

Additional terms:

• Only I, Cam R. (the only creator of Untilted), am allowed to use my membership comics, and all other art by extension, for commercial purposes, including but not limited to, selling merchandise, advertising, or promoting products or services. No one else is allowed to do so without my explicit written permission.
• You may not frame or embed the membership comics on other websites, except for the purpose of sharing a link to the original work. In addition, all official Untilted comics will be primarily on this website within a membership, but I reserve the right to also distribute it or display it through other approved channels (in case this website becomes non-functional for whatever reason).
• You acknowledge and respect the creator's moral rights, including the right to be attributed and the right to protect the work's integrity, and will not do anything that could damage the creator's reputation or goodwill.
• You may not use automated tools or scripts to scrape or download the comics, except for the purpose of accessing the work for personal (private) use.
• If you breach any of the terms or conditions of this license, your permission to use the work will be terminated, and you must immediately stop using the work and destroy any copies you have made.

(Note: this may not apply to certain Untilted art or other art by Cam R. that is intended for the wider public, including selected work-in-progress drawings. Those may be published under various Creative Commons licenses and differing terms other than CC-BY-ND).

Furthermore, except as otherwise noted, all content accessible on this site is protected by copyright law and is also subject to Payhip's terms and conditions. You may not reproduce, distribute, display, modify, perform, scrape or use for data analysis or in the training or operation of artificial intelligence (AI) systems, or otherwise exploit any of the content (in whole or in part) without obtaining prior express written permission from either Cam R. or Payhip, depending on what content is used.

4. Payment Terms

All prices are listed in United States Dollars (USD). Payments are processed through Payhip using Stripe and PayPal. As of now, subscription payments can only be processed with Stripe through credit/debit card payments. All other digital products allow for the PayPal option. You must provide accurate payment information at the time of purchase. By making a purchase, you agree to pay all charges incurred.

5. Refund Policy

Subscriptions are billed on a recurring monthly basis. You may cancel your subscription at any time before the next billing cycle to avoid being charged for the next period.

• If you cancel your subscription, you will continue to have access to the membership until the end of the current billing period. Refunds for the current billing period will not be issued.
• If you believe you have been charged in error or have a specific issue, please contact me on the contact form located on the Contact page. I will review your request and respond within 2-3 days. (Note: Payhip is not able to refund you, only I can)
• Digital products are non-refundable due to their nature. However, subscriptions can be refunded, but you'll need to contact me directly so that I can fully refund you.

6. Privacy Policy and Cookies

Please see Payhip's Privacy Policy and Cookie Policy for details on how we collect, use, and protect your information (including cookies).

• Other than that, when you email me, I collect your email address and any other information you provide; however, that information is confidential and never shared with a third party (except the email provider I use). Email is used to respond to your inquiries, send emails about updates and provide customer support. I retain your personal data for as long as necessary to fulfill the purposes outlined above, unless you specifically request to me that I delete it sooner.

7. Powered by Payhip

This website is powered by Payhip. This means that:

• Payment Processing: When you make a purchase on our site, Payhip handles the payment. We do not store your payment information. For details on how Payhip manages your data, please check their Terms of Service and Privacy Policy.
• Service Issues: If there are any problems with payments or access to your purchases, those issues are managed by Payhip. We will do our best to help, but you may need to contact Payhip directly for payment-related questions.
• Agreement: By using our website, you agree to both our Terms of Service and Payhip's Terms of Service. And all other policies by them.

8. Third-Party Websites

This website may have links to other websites that I do not control. I may not be able to check if the information or material on any linked third-party website is right or safe (unless I am, in fact, affiliated with them). If you click on a link and leave this website, its rules no longer apply. You are fully responsible for what you see or do on those websites. Please read their terms and policies before you use them or make any purchases. I am not liable for any problems that happen while you use those other websites or their content.

Refunds Policy: Digital products can't be refunded due to their nature. Subscription policy is listed under Refund Policy in the Terms of Service.

Delivery times: Instant (because I only sell digital products and I am not able to do physical delivery at this time).

Accepted payment methods: PayPal (digital products only as PayPal cannot process subscriptions on Payhip), American Express, Maestro, MasterCard, and Visa.

Payment period: Credit card payments are (usually) processed immediately.

• Untilted Free Plan: $0
• Untilted Premium Plan: $10 (monthly)

Schedule: 9 a.m. to 5 p.m. Eastern Standard Time, Monday through Friday. This is the schedule I am most likely to be active.

10. Limitation of Liability

The owner of this website operates as a sole proprietorship as Camille Reyes-Sanchez (Cam R. for short) and is committed to providing quality products and services. However, by using this website and purchasing any products, you agree to the following terms. To the fullest extent permitted by applicable law, this website and its owner disclaim all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of this site or our products. In no event shall the total liability of the website or its owner for any claims related to these products, whether in contract, tort (including negligence), or any other legal theory, exceed the amount paid by you for the product in question. Certain statutory rights may not be waived, and nothing in this disclaimer shall limit your rights where such limitations are not permitted by law.

11. Dispute Resolution

Any disputes arising out of or related to these Terms of Service shall be resolved exclusively through mediation in New York City, New York. Both parties agree to make a good faith effort to resolve any disputes through mediation before seeking any other remedies.

To initiate mediation, either party can simply reach out to the other party to discuss the issue. The parties will then mutually select a mediator. If the parties cannot agree on a mediator within 14 days, either party may request the American Arbitration Association (AAA) to provide a list of qualified mediators.

The costs of mediation will be shared equally by both parties. The mediation process shall be confidential, and any statements made during mediation cannot be used in any subsequent legal proceedings.

12. Changes to the Terms

I may update these terms from time to time. Users will be notified of significant changes via a notice on our website. Your continued use of the website after any changes constitutes acceptance of the new Terms of Service.
